These terms apply between Elena Yasnova, NIE Y3005968C, Avenida Palm-Mar 43, Residencial Corazones, 38632 Arona, Santa Cruz de Tenerife ("we"), and the guest booking an apartment on the websites tene-sur.com and surtenerife.com.
The apartments are holiday homes (vivienda vacacional) in Tenerife, registered in the Tourism Register of the Canary Islands; each apartment's registration number is shown on its page and in the booking confirmation. This is a tourist accommodation contract (Decree 113/2015), not a residential lease.
The price is shown when you book and includes IGIC at 7 %. To confirm the booking, a deposit of 20 % of the price of the stay is paid online via Stripe or PayPal. The balance is paid at check-in by bank card or in cash, within the limits allowed by Spanish law.
Under Spanish law (Royal Decree 933/2021) we must register all guests, including children. Before arrival or at check-in, each guest shows an identity document; for children, their relationship to the adult is stated. Check-in is not possible without registration.
A security deposit of €300 in cash is paid at check-in. It is returned in full on the day of departure after the apartment has been inspected. Only the cost of confirmed damage is deducted from it; we tell you the amount and the reason.
Check-in from 15:00 to 22:30, check-out from 8:00 to 11:00. Other times by prior arrangement.
— You can cancel your booking free of charge within 24 hours of paying the deposit, but no later than the start of your stay: the deposit is refunded in full.
— After 24 hours the deposit is non-refundable — in case of cancellation, no-show or a change to the booking made by the guest.
— If you leave early, the days not used are not refunded.
— If we cancel the booking, you get back the full amount you have paid.
The 14-day right of withdrawal does not apply to accommodation services for specific dates (Art. 103 l) of the Spanish consolidated consumer protection law, TRLGDCU).
No more guests may stay in the apartment than stated in the booking and in the apartment's registration; all guests count, including children. Additional guests are allowed only with our consent and within the permitted occupancy.
Quiet hours from 22:00 to 8:00; smoking inside the apartment is not allowed; pets are not allowed; parties and noisy events are not allowed; please treat the property with care; use only the parking space assigned to you.
The guest is responsible for damage caused by them and their companions to the apartment and to common areas. If, because the guest broke the house rules (noise, smoking, parties, extra guests), the authorities impose a fine on the owner, or neighbours, the owners' community or the authorities claim costs from the owner, the guest reimburses them in the confirmed amount. In case of a serious or repeated breach of the rules we may end the stay without refunding the remaining days. We are not responsible for the guest's personal belongings, except where we are at fault or negligent.

Spanish law applies. A guest who is a consumer may bring proceedings before the courts of their place of residence.
